By accessing or using martstok.com (the "Site") or engaging MartStok LLC ("MartStok," "we," "us") to provide services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Site or our services.

Services provided by MartStok — including retail analytics, inventory optimization, and market and pricing advisory — are governed by a separate written engagement letter or master services agreement ("MSA") between MartStok and the client. In the event of any conflict between these Terms and an MSA, the MSA controls.
Unless otherwise stated in a signed MSA, all fees are quoted in U.S. dollars and are due within 15 days of invoice date. Late payments accrue interest at the lesser of 1.0% per month or the maximum rate allowed by law.
All content on the Site — including text, graphics, logos, images, and code — is the property of MartStok or its licensors and is protected by U.S. and international copyright and trademark laws. "MartStok" and the MartStok logo are trademarks of MartStok LLC. You may not use these marks without our prior written consent.
Deliverables produced for a specific client are licensed or assigned to that client as specified in the applicable MSA.
The Site may contain links to third-party websites. We do not control and are not responsible for their content, privacy practices, or availability. Access to third-party sites is at your own risk.
The Site is provided "as is" and "as available" without warranties of any kind, whether express or implied. MartStok does not warrant that the Site will be uninterrupted, error-free, or free of harmful components. Information published on the Site is provided for general purposes and does not constitute financial, legal, or tax advice.
To the maximum extent permitted by law, MartStok and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of the Site or our services. Our total liability, whether in contract, tort, or otherwise, is limited to the greater of (a) the fees paid by you to MartStok in the twelve months preceding the event giving rise to the claim, or (b) US $500.
You agree to indemnify and hold harmless MartStok from any claims, damages, or expenses arising out of your breach of these Terms or your misuse of the Site.
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute arising under these Terms shall be brought exclusively in the state or federal courts located in Harris County, Texas, and you consent to the jurisdiction of those courts.
We may update these Terms from time to time. The updated version will be posted on this page with a new effective date. Your continued use of the Site after any changes constitutes acceptance of the revised Terms.
